Daily Fantasy Sports: Is the Gambling “Unlawful”

Attorney David Boies of DraftKings addresses the recent ban of sites like DraftKings and FanDuel.

As the two online gambling forums have increased in popularity, the State of New York has banned them from use within its boundaries. The Apps (or websites) determine this based on either the current satellite location of the user, or the address tied to the user’s billing information. There are ways around this, of course, such as using Paypal to add money to one’s account. Attorney Boies, however, argues that this may not be necessary.

The State Constitution of New York bans “unlawful” gambling, not gambling of any kind. Gambling that has been deemed lawful in the State of New York include, casinos and horse races (Yonkers raceway, for example).

The appropriate legal step that must be taken, according to Boies, is to determine if these mobile sports-gambling-sites are legal or not.

Individual users of the gambling platforms have both won large to mediocre sums of money, while others continuously lose money each week.
