Police say upstate man stopped with four times the legal blood alcohol

LATHAM - A Sharon Springs man twice surprised a state trooper on Wednesday.  First, the man was found to be driving while nearly four times the legal limit for alcohol.  Secondly, it wasn’t yet 1:00 p.m.  

Michael Mackey, 36, was stopped on State Route 10 in the town of Sharonfor failing to signal for a turn into Green Road in the Town of Sharon. Following his arrest for Driving While Intoxicated, it was determined that Mackey’s blood alcohol concentration was .30%, far exceeding the .08% legal level of intoxication.  The charge became a felony when it was discovered that Mackey had a conviction for DWI within the previous ten years.  

Mackey was arraigned and sent to the Schoharie County Jail in lieu of $1,000 bail.  He will return to the Sharon Town Justice Court at a later date.
