Commercial driver license exam cheating scandal revealed, 21 arrested

NEW YORK - State Inspector General Catherine Leahy Scott and Manhattan District Attorney Cyrus Vance, Jr., announced the arrest and indictment of 21 individuals charged with cheating on their New York State Department of Motor Vehicles (DMV) Commercial Driver License (CDL) written examinations. This new development is part of Inspector General Scott’s ongoing investigation into the CDL test cheating scheme first revealed in September of last year.

“People with commercial driver licenses operate school buses and heavy trailered vehicles that carry hazardous chemicals and petroleum,” said Inspector General Scott.  “We entrust the operators of these vehicles to safely bring our children to and from school. We count on them to navigate very busy transportation networks without getting into catastrophic accidents. Test cheating puts innocent people at grave risk and cannot be tolerated. I have conducted this investigation to ensure the safety of our communities and to hold test cheaters accountable. I will continue to work closely with District Attorney Vance identifying and arresting test cheaters and those who have promoted this dangerous scheme to be sure the individuals we have arrested will be held fully accountable for their criminal activity.”

Those arrested are charged with offering a false instrument for filing in the first degree (penal law section 175.35), and false statements, alteration of records or substitution in connection with examination (vehicle and traffic law section 392) for allegedly cheating on their cdl exams:

  9. Denton Harding, 45, of St. Albans, N.Y.
  10. Luis Hernandez, 36, of Ozone Park, N.Y.
  11. Holger Marin, 51, of Elmhurst, N.Y.
  12. Jose Martinez, 33, of Westbury, N.Y.
  13. Juan Martinez, 37, of Brentwood, N.Y.
  14. Agim Mustafaj (Kelmendi), 33, of Putnam Valley, N.Y.
  15. Nayib Pena, 21, of Yonkers, N.Y.
  16. Jose Quiroz, 32, of Copiague, N.Y.
