Death of 3 year-old investigated in Jefferson County

WATERTOWN - At approximately 6:00 Monday morning, State Police in Watertown responded to a residence on Empie Road, in the Town of Lyme, Jefferson County, for an unresponsive child. 

Victoria Kathryn Nicole Marchyotti, 3, was unable to be resuscitated, and was subsequently pronounced at her residence prior to medical transport.  

At this time, an investigation into the death of this child is ongoing. This investigation is being conducted in conjunction with the Jefferson County Sheriffs Department, the Jefferson County District Attorney, and Medical Examiners Office.

The adoptive parents of the child called 911. The child, whose birth name was Kate Cawvey, was a victim of an assault in 2011 in which she suffered a traumatic brain injury.  The investigation into the child's death will continue including facts relating to the 2011 assault.  In March of 2012, Kelly Keegan was found guilty of first and second degree assault and sentenced to 25 years in prison for assaulting the child while baby-sitting her at their home just outside Three Mile Bay. 

If any criminal liability is developed in the course of this investigation that relates to the 2011 assault, it will be addressed accordingly, authorities said
