Repeat con man pleads guilty to scam

ALBANY -  A man who spent a decade in prison is likely heading back.  Frank Kindlon, 69, of Delmar, pled guilty to one count of grand larceny in the second degree, a class c felony, today in Albany County Court.

Between April 2009 and March 2011 Kindlon stole over $200,000 from a victim by means of making false representations which induced the victim to provide cash payments to the defendant for what the victim believed to be various “surcharges,” “taxes,” “security,” “and courier fees,” for a fictitious court case.  Kindlon convinced the victim that she was under a Judge’s order to comply with the law and required to provide these cash payments. 

“Today this defendant pleaded guilty to the entire indictment against him, removing the people from further negotiations and relying on the court for the mercy that we were unwilling to offer”, said District Attorney P. David Soares.  “Repeated financial fraud will not be tolerated in Albany County and I hope that the court will sentence Mr. Kindlon in accordance with the crimes he has admitted to.”

Kindlon was previously convicted of several counts of Grand Larceny in 1993 and served 10 years in State Prison.  He faces up to 15 years in state prison when sentenced in October
