Repeat DWI offenders heading to prison

ALBANY – Two Albany County men, who pled guilty to repeat DWI offences, will spend time in state prison. 

Brian Burkins, 46, of Albany, pleaded guilty to one count of driving while intoxicated, a Class E felony, in Albany County Court.  On March 15, 2012 Burkins operated a vehicle the wrong way on the one way portion of Lexington Avenue in the City of Albany while having a blood alcohol content of .15%, nearly double the legal limit under New York State Law.  This was Burkins’ fifth alcohol related conviction.

Burkins faces 1 to 3 years in State Prison, license revocation, Ignition Interlock Device for 3 years upon release from custody, and $1,520 in fines and surcharges when sentenced on July 10.

In an unrelated case, Michael Lamanna, 57, of Colonie, pleaded guilty to one count of driving while intoxicated, a felony.

On March 28, 2012 Lamanna was observed operating a vehicle and committing various traffic infractions by Colonie Police Officers.  Officers attempted to pull the car over and Lamanna increased speed and rear-ended another vehicle.  No one in the other vehicle was seriously injured. 

Lamanna was found to have a blood alcohol content of .33%.  This is his fifth alcohol related conviction.

Lamanna is facing a sentence of 1 1/3 to 4 years in State Prison, license revocation, Ignition Interlock Device for 3 years upon release from custody, and $1,520 in fines and surcharges when sentenced on June 26.
