Man guilty of murdering former girlfriend’s new boyfriend |

GOSHEN – It took an Orange County Court jury almost three days, but late Friday afternoon, they returned a guilty verdict against Todd Sinclair for killing Randy Kizer on February 2, 2011. Sinclair, 22, had admitted to shooting and killing Kizer, 26, of Port Jervis, in a car after he chased Kizer through the streets of Port Jervis. But, Sinclair maintained he suffered from “extreme emotional disturbance” at the time. District Attorney Frank Phillips said Assistant DA Lorri Goldberg proved that to be untrue. “I think she was able to paint a picture for the jury of someone who clearly planned this act and acted rationally and reasonably and not under an extreme emotional disturbance,” Phillips said. Sinclair was fixated on the woman who was with Kizer in his car and when Sinclair fired his weapon repeatedly, the woman was not injured. When sentenced for murder in the second degree, Sinclair faces 25 years to life in prison.
