Drunk granny admits driving truck into daycare, injuring a young child |

ALBANY- Marion Albert, 78, of Albany, pled guilty the ten-count indictment that included two counts each of Aggravated Vehicular Assault, Vehicular Assault in the First Degree, a Class “D” Felony, and one count of Aggravated Driving While Intoxicated, all felonies. Albert faces up to 3 to 9 years in prison under the terms of the plea agreement between Albert and the Court when sentenced on May 6. On the afternoon of August 20, 2009, in the vicinity of Second and Quail Street in Albany, Albert backed her truck out of her driveway, floored it across the street, accelerated up and over the curb, across the sidewalk, and crushed a female victim into a daycare center located at 43 Quail Street. Albert drove her truck through the wall of the daycare center, partially into the room where the infants were located. The female victim suffered a left femur fracture and hip fracture requiring surgery and on-going treatment. Albert had a BAC of .25%, or three times the legal limit, at the time her blood was drawn. |
