Fingerprint leads to guilty plea and sentence

ALBANY - Robert Dempsey, 42, of Orange Street in Albany, was sentenced to nine years in prison and five years post release supervision as a second felony offender.

In April, he pled guilty to one count of Burglary in the Second Degree, a Class “C” Violent Felony. DEMPSEY was previously convicted of the crime Attempted Burglary in the Third Degree in March 2002.

Between July 30, 2007 and July 31, 2007, Dempsey entered a residence at 225 Western Avenue through a window. While inside, he stole a rifle and a shotgun along with various other items. Later that evening, Albany Police received a call about a man walking down the street with some guns. Upon responding, Officers recovered the guns and other items from Dempsey. The owners identified the weapons and Dempsey had no permission to be in the residence. As part of the investigation, Albany Police were able to lift fingerprints from the window. The prints were sent to DCJS where a match was made with Dempsey.
