Five sentenced in asbestos removal case |

Five individuals, who cooperated extensively in the prosecution of Alex and Raul Salvagno and AAR Contractor, Inc. during the longest asbestos removal prosecution in United States history, were sentenced for their roles in federal court in Albany, NY by the Honorable Lawrence E. Kahn. AAR was also sentenced. Those listed below were sentenced to the following: 1) AAR Contractor, Inc., was sentenced to pay $22,875,575.46 as restitution to victims of the asbestos scheme. AAR was also directed to forfeit $2,033,457.00 to the United States. AAR was convicted following a five month trial of a conspiracy to violate the federal racketeering statute (including numerous acts of obstruction of justice, money laundering, mail fraud, and bid rigging), a conspiracy to violate the Clean Air Act and Toxic Substances Control Act and substantive Clean Air Act violations. AAR Contractor, Inc. was as asbestos abatement company owned by Alex and Raul Salvagno. The Salvagnos were previously sentenced to 25 and 19.8 years, respectively, in prison and were also ordered to pay restitution and forfeiture in amounts similar to AAR. They are currently serving their sentences in prison. 2) Timothy Carroll, 44 years old, Albany, NY, was sentenced to 26 months in prison, followed by two years of supervised release and 200 hours of community service. He was directed to pay $22,875,575.30 in restitution to victims. Carroll pled guilty to a conspiracy to violate the Clean Air Act and to commit mail fraud. Carroll was the public owner of Analytical Laboratories of Albany (ALA). 3) Gary Alvord, 40 years old, Niskayuna, NY, was sentenced to 15 months in prison, followed by 2 years of supervised release. He was further directed to perform 200 hours of community service. Mr. Alvord was the AAR Director of Operations. He pled guilty to a conspiracy to violate the Clean Air Act and Toxic Substances Control Act and to substantive Clean Air Act violations. 4) Robert Obrey, 40 years old, Scotia, NY, was sentenced to 15 months in prison, followed by 2 years of supervised release. He was further directed to perform 200 hours of community service. Mr. Obrey was an AAR field supervisor. He pled guilty to a conspiracy to violate the Clean Air Act and Toxic Substances Control Act and to substantive Clean Air Act violations. 5) Philippe Goyeau, 43 years old, West Sand Lake, NY, was sentenced to 8 month in prison, followed by 2 years of supervised release. He was further directed to perform 200 hours of community service. Mr. Goyeau was the ALA Executive Director. He pled guilty to a conspiracy to violate the Clean Air Act. 6) Alison Gardner, 42 years old, Medusa, NY, was sentenced to 3 years of Probation and 300 hours of community service. Mrs. Gardner was the ALA Laboratory Director. She pled guilty to a conspiracy to violate the Clean Air Act and to commit mail fraud. |
